Things are becoming clearer for paid holidays that employers can impose on their employees during this crisis period. One of the ordinances of the Ministry of Labor, presented this Wednesday, March 25 in the Council of Ministers, details the new rules of the game. It is thus expected that, in the case of obtaining a branch or company agreement, a employers can require their employees to take six days of paid vacation.

And this, either by making them ask new days, or by asking them to modify the dates of leave already set. In this second case, for example, if an employee had asked for a week off in June before the crisis, his company could ask him to postpone it to the end of March / beginning of April. In addition, the employer can be satisfied with a notice period of at least one clear day to impose the desired leaves (understand to let his employee know that he must ask for his days only one day before the date decided by the ’employer).

In addition, this period of leave imposed or modified in application of this ordinance “cannot extend beyond December 31, 2020”, specifies the text. What allow companies to anticipate an extension of the containment period. Note that these provisions are in addition to the rules of ordinary law, namely the possibility for the employer to modify (and only to modify) the paid vacation dates already set by its employees, with a notice period of four weeks .
