Lego has been slapped on the fingers by the Competition Authority. The companies Cdiscount and EMC Distribution (referencing central of the Casino group) had taken the matter to complain about practices put in place by Lego. They accused it of a “discriminatory pricing policy vis-à-vis online resellers”, such as Cdiscount but also Amazon, to the detriment of other “classic” resellers such as toy stores (JouéClub, KingJouet, La Grande Récré or Toys’R’Us), favored here in the face of this competition, explains a press release from the Authority.

At the end of 2013, the Danish company revised its price list for resellers. Lego then increased its prices by 15%, while granting a “functional discount” of up to 13%. The problem, according to the Competition Authority, is that “certain criteria for awarding the discount de facto excluded operators selling exclusively on the Internet”. Depending on the period, the difference between internet resellers and others could reach 7 to 9%. In the eyes of the body, “these practices could constitute a discriminatory price differentiation liable to have anti-competitive effects”.

It is not specified what Lego’s line of defense was in the face of these accusations. But the toy company has proposed to modify and clarify the criteria for awarding this famous “functional discount” for online resellers. A market test will be in place until September 15th. “At the end of the procedure, if the proposed commitments, possibly supplemented and amended, are such as to respond to the competition concerns expressed, the Authority may proceed to the closure of the case, taking note of the commitments, which will then take a mandatory character ”, concludes the Competition Authority.
